US Federal Circuit upholds Commerce’s use of adverse facts to calculate antidumping duties for steel nails from China

The US Court of Appeals for the Federal Circuit yesterday upheld the Commerce Department’s use of adverse facts to calculate antidumping duties for the 10th administrative review of steel nails from China.
Commerce applies adverse facts available (AFA)  when it deems that a company has been uncooperative in responding to requests
