Comment: Last-chance damages could add to risks for companies challenging EU cartel fines

A cartel member’s decision to challenge an EU fine now risks triggering extra litigation years later by claimants who missed the deadline to file their damages actions against other cartelists.
This is a lesson that Toyota has learned in Spain in a case now subject to an EU preliminary ruling.
