Facebook-Kustomer deal may clarify Germany’s ‘substantial operations’ test for deal review

Facebook’s acquisition of customer-service platform Kustomer may provide clarity in Germany over how large a company's operations in the country must be to trigger a merger review there, a senior Bundeskartellamt official has said.

Fabian Pape, speaking in a personal capacity, told a conference* today that the Facebook-Kustomer deal did not meet Germany's turnover threshold.
