Can non-compete deals across different industries be illegal, EU judges asked

Can a non-compete agreement between two companies breach EU cartel law if they are in different businesses and unlikely ever to be rivals? That is a question put to EU judges arising from a dispute between Energias de Portugal and Sonae on one side, and the Portuguese competition authority on the other.
