Votorantim Cimentos wants to withdraw a pending appeal with Brazil's second-highest court in a lawsuit stemming from a cartel investigation where the national antitrust agency convicted several cement makers.

The request has been handed to Minister Herman Benjamin, the judge presiding over the case at the Superior Court of Justice. In a recent development, Benjamin asked if the defendant, the Administrative Council for Economic Defense, or CADE, agrees with the request.

A CADE spokesperson told MLex the agency hasn’t been notified of the withdrawal request, so it couldn’t comment.
